These Terms of Service govern your access to and use of the BLINK Network website, blockchain network, and related services.
1. Acceptance of terms
By accessing or using BLINK Network services, including the website at blink.network, the BLINK blockchain network, developer tools, dashboards, APIs, and any related applications (collectively, the "Services"), you agree to be bound by these Terms of Service.
If you do not agree to these terms, you must not access or use the Services. These terms apply to all visitors, users, developers, issuers, validators, and institutions.
2. Definitions
For the purposes of these Terms:
- "BLINK" refers to the BLINK Network, its protocol, associated software, and the organization operating this website.
- "Network" means the BLINK blockchain network and any connected chains, bridges, or infrastructure.
- "Tokens" means BLINK tokens and any digital assets issued, transferred, or managed on the Network.
- "Services" means all products, tools, dashboards, APIs, documentation, and support provided by BLINK.
- "User" means any individual or entity accessing or using the Services.
3. Use of services
You may use the Services only if you meet the following conditions:
- You are at least 18 years old or the age of legal majority in your jurisdiction.
- You are not located in, or a resident of, any jurisdiction where use of the Services is prohibited by law.
- You are not subject to sanctions or listed on any prohibited persons list.
- You will comply with all applicable laws, regulations, and these Terms.
Prohibited uses include: attempting to interfere with network security, using the Services for fraud or money laundering, circumventing compliance controls, infringing intellectual property, or violating any applicable law.
4. Token issuance
BLINK provides tools for issuing tokens on the Network. By issuing a token, you represent and warrant that:
- You have the legal right to tokenize the underlying asset or right.
- The token and its offering comply with all applicable laws in relevant jurisdictions.
- You will maintain accurate reserves, disclosures, and compliance configurations as required by BLINK modules.
- You understand that token issuance creates immutable on-chain records.
5. Compliance
BLINK is designed to support regulatory compliance, but each user remains responsible for their own legal and regulatory obligations. You agree to:
- Conduct appropriate legal and regulatory due diligence before issuing, transferring, or holding tokens.
- Provide accurate information during identity verification and compliance checks.
- Cooperate with regulators, auditors, and BLINK compliance processes when required.
- Not attempt to bypass transaction screening, jurisdiction checks, or other compliance controls.
6. Intellectual property
BLINK and its licensors own all rights, title, and interest in the Services, including software, designs, trademarks, logos, documentation, and content made available through the website.
You may not copy, modify, distribute, sell, or reverse-engineer any part of the Services without prior written permission, except as permitted by applicable open-source licenses for specific software components.
User content submitted through the Services remains yours, but you grant BLINK a license to use it as necessary to operate and improve the Services.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, BLINK disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service.
Blockchain networks are subject to risks including but not limited to software bugs, network congestion, attacks, and regulatory changes. BLINK does not guarantee the security, finality, or value of any transaction or token.
8. Limitation of liability
To the fullest extent permitted by law, BLINK and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Services.
In no event will BLINK's total liability exceed the greater of (a) the amount you paid to BLINK for the Services in the twelve months preceding the claim, or (b) one hundred US dollars (USD 100).
9. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.
Any dispute arising from these Terms or the Services will be resolved through binding arbitration in Zug, Switzerland, unless otherwise required by applicable law. Each party waives any right to participate in class actions or class-wide arbitration.
10. Changes to terms
BLINK may modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. We may also notify users through the Services or other communication channels.
Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.
